Terms of Service

These Terms of Service govern your access to and use of SaltyShelf, a marketplace platform operated by TideCrest LLC ("TideCrest," "SaltyShelf," "we," "us," or "our"). By accessing or using SaltyShelf, you agree to be bound by these Terms.

Marketplace Role

SaltyShelf is a marketplace platform that enables independent buyers and sellers to discover, list, communicate about, and arrange transactions involving reef aquarium equipment, livestock, coral, supplies, and related goods. TideCrest LLC is not a party to any transaction between users unless expressly stated in writing. Sellers are solely responsible for their listings, item descriptions, prices, availability, legality, quality, condition, packing, shipping, delivery, refunds, warranties, and compliance with all applicable laws. Buyers are solely responsible for evaluating listings, sellers, item condition, transaction terms, shipping arrangements, shipping risks, and legal compliance before purchasing or receiving any item.

No Responsibility for User Transactions

To the fullest extent permitted by law, TideCrest LLC and SaltyShelf are not responsible or liable for any transaction, communication, payment, shipment, delivery, loss, delay, misrepresentation, damaged item, dead-on-arrival livestock, pest introduction, disease, tank loss, injury, property damage, dispute, refund, chargeback, warranty claim, regulatory issue, or other matter arising from or related to dealings between users. Any transaction you enter into through or because of SaltyShelf is solely between the buyer and the seller, and each user assumes all risks associated with that transaction.

User Assumption of Risk

Reef aquarium livestock, coral, equipment, chemicals, electrical components, plumbing, water systems, and shipping methods can involve significant risks. You understand and agree that you use SaltyShelf, contact other users, buy items, sell items, ship items, receive items, install equipment, introduce livestock, and rely on listing information at your own risk. You are responsible for quarantining livestock, inspecting equipment, confirming compatibility, following manufacturer instructions, and obtaining professional advice when appropriate.

User Content and Listings

Users are solely responsible for all content they submit, including photos, descriptions, messages, prices, claims, certifications, livestock health statements, shipping representations, and seller profile details. TideCrest LLC does not guarantee the truth, accuracy, completeness, legality, safety, or reliability of any listing or user content. We may remove, modify, restrict, suspend, or refuse any content or account at our discretion.

Prohibited Conduct

You may not use SaltyShelf to violate any law, sell prohibited or restricted items, misrepresent an item or identity, infringe another party's rights, evade marketplace rules, harass users, interfere with the service, upload malicious code, scrape the service without permission, or engage in fraudulent, unsafe, deceptive, or abusive conduct.

No Warranties

SaltyShelf is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, TideCrest LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, uninterrupted operation, and any warranties arising from course of dealing or usage of trade.

Limitation of Liability

To the fullest extent permitted by law, TideCrest LLC, SaltyShelf, and their owners, officers, employees, contractors, agents, affiliates, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, lost profits, lost revenue, loss of data, loss of livestock, tank crashes, replacement costs, personal injury, property damage, or other losses arising out of or related to your use of SaltyShelf or any user transaction, whether based in contract, tort, negligence, strict liability, warranty, statute, or any other theory, even if advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless TideCrest LLC, SaltyShelf, and their owners, officers, employees, contractors, agents, affiliates, and service providers from and against all claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of SaltyShelf, your listings, your transactions, your communications with other users, your violation of these Terms, your violation of law, or your infringement of any third-party right.

Disputes Between Users

Users are responsible for resolving disputes directly with one another. SaltyShelf may, but has no obligation to, provide tools, information, moderation, or account action in connection with a dispute. Any involvement by TideCrest LLC does not make TideCrest LLC a party to the transaction or create any duty, warranty, guarantee, or liability.

Changes to These Terms

TideCrest LLC may update these Terms at any time. Updated Terms are effective when posted unless a different effective date is stated. Continued use of SaltyShelf after changes are posted means you accept the updated Terms.

These Terms are a general website draft and are not legal advice. Marketplace laws, consumer protection rules, livestock regulations, payment rules, warranty limitations, liability waivers, arbitration clauses, and enforceability requirements vary by jurisdiction. TideCrest LLC should have these Terms reviewed by a licensed attorney before relying on them for production use.
